Norwegian Air Shuttle bankruptcy 2021 – What does this mean for you?

It is no news that the airline Norwegian was under enormous financial pressure, and therefore, went under a reconstruction process. The reconstruction was brought to the Norwegian and Irish courts, and therefore the company’s future was decided in Norway and Ireland. Norwegian avoided bankruptcy, but several passengers who had bought tickets from Norwegian were entitled to compensation because of the inconveniences they encountered with their Norwegian Air Shuttle flights.

After the reconstruction, Norwegian could write off 95% of the debt to their customers. Therefore, your credit from Norwegian Air Shuttle will no longer have the same value as when you made your booking. This reconstruction was accepted on April 9, 2021. However, it is still possible to book a flight with Norwegian, and therefore of course you still have some rights for future refund and compensation after this date. Therefore, if you have experienced a canceled or delayed flight after April 9, 2021, avoid losing your flight money. Contact us at Air Delay and find out more about your rights.

Norwegian Airlines

Norwegian Air was formerly known as Norway Airlines. The airline is located in Scandinavia, but it is one of the largest airlines in Europe in terms of the lowest costs. Norwegian Air was founded in 1993 by employees from the former airline Busy Bee. Norwegian’s biggest base is located at Oslo Airport. Norwegian Air Shuttle has 4 subsidiary airlines that work under it offering scheduled flight services all around the world. These airlines are Norwegian Long Haul Airlines, Norwegian Air International, Norwegian Air UK, and Norwegian Air Argentina.

What does the Norwegian 2021 reconstruction mean?

When an airline gets into financial trouble and there is a real chance that the company can go bankrupt, a reorganization process is initiated. A trustee is selected who will take the final conclusion to look after everyone’s interests. The purpose of this process is for the company to come up with a plan for how it can turn around its financial problems and become a healthy business again, thus avoiding bankruptcy. This is good for the many investors who are at risk of losing their investment.

If you have shares in Norwegian Air Shuttle, then only time will tell whether the exchange rate will ever return to how it once was. Furthermore, the share is still low for Norwegian despite the new capital and the approval of this reconstruction. We will leave these estimates up to you as an interested party or analyst.

This reconstruction was the reason why Norwegian has not paid compensation or refunds for a flight delay or a flight cancellation to customers in the last months. However, you are entitled to compensation for your delayed and canceled flights since April 9, 2021 as they have continued operations. This is due to EU Regulation 261/04, which dictates that all airlines must pay this compensation. If you have experienced a delayed or canceled flight, you can contact us via the button below.

What does this mean for your flight delay compensation and refund?

It was agreed that Norwegian will offer customers up to 5% of their legal receivables, either compensation or a refund. However, it is not clear when or if customers will receive this money at this time. Once the airline has expressed an acceptance of your receivable, it often takes a long time for this payment to take place. However, this means that one can expect to receive a maximum of 5% of the amount that one was originally entitled to.

After this reconstruction, you can again get compensation for your flight delays and cancellations. You can do this when you are delayed more than 3 hours and fly from or to Europe. If you are flying from the USA or outside Europe, you must have flown with companies that are European. This can e.g. be SAS, Norwegian or Ryanair. Norwegian has had many flights since the reconstruction and you can book trips to the USA, Europe, and Asia.

What now? What does a Norwegian bankruptcy mean?

Norwegian Airlines’ reconstruction is now finally valid and all documentation has been sent from the relevant courts, which in this case are the Irish and Norwegian courts. Since the courts chose to accept this proposal, unfortunately, there is nothing else to do in relation to your claim that lies before 9 April 2021. After this acceptance, we unfortunately have no legal justification to go further.

We at Air Delay think that you should not accept that there is nothing to do, and therefore we would recommend that you check if you have used a travel company when you booked your trip. In some cases, Norwegian may have transferred the money to the travel company before they made their reconstruction. Thus, before sending a compensation or refund request about your Norwegian flight delay or flight cancellation it is important to check the travel agency where you have booked your flight and send a request to them instead of Norwegian Air Shuttle.
