Rights in case of TAP Air Portugal cancellation and delay

It is always a nuisance when an airline announces canceled flights or a long flight delay. Whether the cause is within the airline’s control or not, it always causes some inconveniences for passengers. That is why the EU has made a Regulation that protects the rights of passengers when it comes to flight delays or cancellations. Here, airlines such as TAP Portugal must pay compensation and refund. However, this compensation does not come easily, and it is always an exhausting struggle for passengers to make a claim, as it can take many months.

When should TAP Air Portugal pay compensation?

When you experience a TAP Air Portugal flight being canceled or delayed that exceeds 3 hours to your final destination, then you can claim compensation. If the cancellation or delay exceeds 3 hours, then you have some passenger rights, under the EU Regulation EC 261/04. This dictates that airlines must pay a fixed amount to the customer, in the event that they do not transport you to your final destination on time. As this is an EU regulation, you must fly from the EU or fly into the EU with a European airline. Below you can see if your flight falls within the scope of the Regulation:

  • Your flight travels from a European country = always entitled to compensation.
  • Your flight travels from a non-European country, but flies to a European country with a European airline = always entitled to compensation
  • Your plane travels from one non-European country to another non-European country. Then you are not entitled to compensation no matter if you fly with a European airline or not.
  • Your plane travels from a non-European country, but flies to a European country with a non-European airline. Then you are not entitled to compensation.

The airline may avoid paying you compensation if they can prove that the reason for the cancellation or delay was caused by extraordinary circumstances. However, most common causes such as technical issues will entitle you to compensation.

If your flight is canceled, airlines such as TAP Portugal must also pay your extra costs and/or a full refund, in addition to the compensation. Often there are extra expenses from the delays and cancellations, such as extra hotel accommodation and meals. The airline is obliged to cover those expenses.

How much can you claim in compensation when your flight is delayed or canceled?

How much you can get in compensation depends on how many hours you were late at your final destination, but also how far is the flight distance. You can see an overview of your compensation for flight cancellation and flight delay below:

  • 1,500 km or less (an entitlement of EUR 250)
  • Between 1,500 km – 3,500 km (an entitlement of 400 EUR)
  • Over 3,500 km (an entitlement of 600 EUR)

For journeys over 3,500 km, you must be delayed more than 4 hours for getting the full amount of 600 EUR. If you are delayed by more than 3 hours, but not more than 4, then various airlines such as TAP Air can reduce your compensation by 50%.

TAP Air Portugal refund of your canceled flight ticket

Do you have the same rights for refunds if you cancel the flight yourself and if the airline cancels your flight? The short answer is no, it is a different situation.

If you would like to cancel your flight it is better that you know the TAP Air Portugal cancellation policy. The policy declares that if you decide to cancel your flight within 24 hours after you made the booking, you will not receive any cancellation fee. However, the flight has to be booked at least 7 days before the departure date. The TAP Air Portugal cancellation fee is one the lowest compared to other airlines.

On the other hand, if TAP Air Portugal decides to cancel your flight there are some factors to look into in order to determine if you are entitled to compensation or a refund. You have to look into your air passenger rights, flight details, and what caused the flight cancellation. If your TAP Air Portugal flight has been canceled, you have several options:

  • You can get the purchase price of the ticket refunded.
  • You can have your tickets rebooked for the next available flight or at a later date.

In the event of a rebooking, the airline must pay for an overnight stay at a hotel and the transportation to and from the airport.

A flight cancellation compensation is not possible if you have been informed about the flight cancellation 14 days before the departure date. The compensation is also not possible if you have already been rebooked by the airline to an alternative flight and the booking meets several time limits.

In addition, the compensation does not apply if the cancellation is due to extraordinary circumstances such as a storm or something outside of the airline’s control.

TAP Air Portugal delayed flight compensation

Flights with delays of less than 3 hours are not eligible for compensation. In other words, you are not entitled to compensation for a delay of two hours, for example.

If your TAP Air Portugal flights are delayed and you have to buy new tickets to arrive, or if you have missed a booked hotel accommodation at your travel destination, then TAP Air Portugal is responsible for those costs.
