Rights in case of easyJet flight cancellation or delay

A flight delay or flight cancellation rarely occurs at a convenient time. Nevertheless, it is not something you can completely avoid, as planes can also experience delays and other disruptions just like any other transport. If you experience a delay or a cancellation, air passenger rights apply to your flights, and you might be eligible for compensation or a refund.

These rights are made by the European Union in order to assist you if you experience any inconveniences during your flights. The EU Air Passenger Rights?

The regulation EC 216 was established in 2004 to protect air passengers against the inconveniences that follow flight disruptions. The regulation applies:

  • To all passengers departing from a country of the European Union
  • To all passengers arriving to a country of the European Union, if the airline is European.

So If you as an air passenger have experienced a flight delay or flight cancellation, there are specific rights you are entitled to, such as compensation and refund. You can usually claim for a flight within 3 years, but it depends on the legislation of the country you bring the claim to.

Since EasyJet is an EU airline, passengers have benefits traveling with them, as they are operating under the EU regulation 261/2004.

If you experience an EasyJet delay or cancellation, then you have various options for compensation or refund. There are three factors that can affect your chances of compensation and refund:

  1. How late do you arrive at your final destination? 
  2. Did you experience any financial expenses?
  3. How long is your flight distance?

EasyJet flight delay: compensation

EasyJet flight delays may be due to various reasons. Extraordinary circumstances are common reasons for delays and cancellations, these include bad weather, air traffic control, strikes, etc. What all of them have in common is that the airline could not have prevented it and therefore can not be held responsible for it. If the reason for your flight disruptions is due to extraordinary circumstances, then you are not eligibe for compensation.

EasyJet also has to provide hotel accommodation (if necessary), food and beverages, while you wait. If EasyJet has not given you vouchers for those expenses, then you have to pay for it yourself but can later on get them reimbursed. However, remember to keep all receipts, so you can show the proof of expenses to the airline. It is also important to remember that these expenses must be reasonable.

If the EasyJet delay causes you to arrive 3 hours later than planned for your final destination, you may receive a EasyJet compensation. Furthermore, how many km you have flown indicate how much compensation you can claim. Below can be seen how much easyJet delay compensation can be given relating to the number of hours delayed and flight distance:

  • A delay of 2 hours or more where the route is less than 1,500 km (€ 250).
  • A delay of 3 hours or more within the EU, where you must fly more than 1,500 km (€ 400).
  • A delay of 4 hours or more outside the EU where flights are 3,500 km or more (€600).

Therefore, it is very important and convenient to know your air passenger rights when flying with airlines like EasyJet.

EasyJet cancelled flight: refund and compensation

In case of cancellations on your EasyJet flights, you might be entitled to both compensation and refund. You can choose to either get the flight tickets refunded or rebook the tickets to the next available departure or at a later time.

The compensation rights regarding cancellations are the same as for delays, it also depends on the flight distance:

  • 1,500 km or less (€ 250)
  • 1,500 km – 3,500 km (€ 400)
  • 3,500 km and outside the EU (€ 600)

However, EasyJet is not obliged to pay you compensation if:

  • You have already been informed about the cancellation of the flight 14 days before departure.
  • You have received a rebooking, which meets specific time requirements.
  • The cancellation is due to extraordinary circumstances.

In addition to compensation, you can choose one of the three options below:

  • Get a full refund of your ticket
  • Rebook your ticket so you can reach the next available flight
  • Get the ticket rebooked so that it can be used at a later time

There can also be cases of denied boarding, due to overbooked flights. Many airlines like EasyJet, overbook their flights because many of the passengers do not show up for their flight, and thus leaving many empty seats in the airplane. That’s why EasyJet books more seats than actually on the plane, to make full use of the plane. In these situations, EasyJet will entitle you to compensation or give you an alternative flight.
