Norwegian Air Shuttle bankruptcy 2021 – what does this mean for you?

It is now no news that the airline Norwegian was under enormous financial pressure, and the company was therefore currently, in the middle of a reconstruction process. The reconstruction was brought before the Norwegian and Irish courts, and it is therefore in Norway and Ireland that the company’s future was decided. Norwegian avoided bankruptcy, but several passengers who had bought tickets from Norwegian have lost the the money they were entitled to due compensation because of the inconveniences they encountered with their Norwegian Air Shuttle flights.

Norwegian came out on the other side of the reconstruction, where they could write down 95% of the debt to their customers. Therefore, your receivable from Norwegian Air Shuttle will no longer have the same value as when you made your booking. This reconstruction was accepted on April 9, 2021. Norwegian Airlines

Norwegian Air was formerly known with the name of Norway Airlines. It was located in Scandinavia. In European terms, it is among the largest airlines in terms of the lowest costs. A second major reason was passenger travel. Norwegian Air Shuttle was founded in 1993 by employees from Busy Bee who planned on acquiring services offered to the regional airline and currently employs over 5,500. Norway’s biggest base is located within Oslo Airport. Norwegian Air Shuttle has 4 subsidiary airlines that work under it offering scheduled flight services all around the world. These airlines are Norwegian Long Haul Airlines, Norwegian Air International, Norwegian Air UK and Norwegian Air Argentina.

What does the Norwegian 2021 reconstruction mean?

When an airline gets into financial trouble and there is a real chance that the company can go bankrupt, a reorganization process is initiated. A trustee is selected who will take the final conclusion to look after everyone’s interests. The purpose of this process is for the company to come up with a plan for how they can turn around their financial problems and become a healthy business again, thus avoiding bankruptcy. This is good for the many investors in the airline who are now not losing their investment.

If you have shares in Norwegian, then only time will tell whether the flight compensation will ever or flight be given to you due to a past flight delay or flight cancellation. Furthermore, the share is still low for Norwegian despite the new capital and the approval of this reconstruction. We will leave these estimates up to you as an interested party or analyst.

What does this mean for your flight delay compensation and refund?

It was agreed that Norwegian will offer customers up to 5% of their legal receivables, either compensation or refund. However, it is not clear when or if customers will receive this money at this time. Once the airline has expressed an acceptance of your receivable, it often takes a long time for this payment to take place. Finally, however, at present this means that one can expect to receive a maximum of 5% of the amount that was originally entitled to.

After this reconstruction, you can again get compensation for your flight delays and cancellations. You can do this when you are delayed more than 3 hours and fly from or to from Europe. If you are flying from the USA or outside Europe, you must have flown with airlines that are European. This can e.g. be SAS, Norwegian or Ryanair. Norwegian has had many more airplanes in the air since the fall. New trips can be made to the USA, the EU and Asia.

What now? What does a Norwegian bankruptcy mean?

Norwegian Airlines’ reconstruction is now finally valid and all documentation has been sent from the relevant courts, which in this case are the Irish and Norwegian courts. Since the courts chose to accept this proposal, unfortunately, there is nothing else to do in relation to your claim that lies before 9 April 2021. After this acceptance, we unfortunately have no legal justification to go further. Therefore, we must look ahead and follow the operations, the share, the route plan and the figures that Norwegian will present in the future. 

We prefer that you do not choose to accept that there is nothing to do, and therefore we would recommend that you check if you have used a travel company when you booked your trip. In some cases, Norwegian may have transferred the money to the travel company before they made their reconstruction. Thus, before sending a compensation or refund request about your Norwegian flight delay or flight cancellation it is important to determine the travel agency where you have booked your flight and send a request to them instead of Norwegian Air Shuttle.
