Delta Air Lines flight delay compensation

In order to claim compensation for a delayed flight, the flight delay must exceed three hours. However, if your Delta Airlines delayed flight is more than 5 hours, there is a possibility to also get your tickets refunded or rebooked to the next available departure(with any airline) or at a later departure chosen by you.

So if you think you are eligible for compensation, then the first thing to look at is to see if the flight delay is more than 3 hours. The next thing to look at is the flight distance because the amount of the Delta flight delay compensation will depend on that. The amount will change based on the following factors:

  • Is your flight 1,500 km or shorter (250 EUR)
  • Is your flight from 1,500 km to 3,500 km (400 EUR)
  • Is your flight outside the EU and over 3,500 km (600 EUR)

Please note that flight delay compensation is not possible if the delayed delta flight is due to extraordinary circumstances. The extraordinary circumstances are for example bad weather, strikes, or other natural occurrences, which are out of the airline’s control. However, to be sure, you always have to check if these extraordinary circumstances do actually apply to your flight. Most airlines use this excuse in order to protect themselves from compensating or refunding you.

Furthermore, it is very important to remember that if delayed flights force you to stay in another country for the night, then you will encounter extra expenses added to your trip, like hotel accommodation, meals, etc. In this kind of situation, it is very important to always remember to keep your receipts so that you can show it to the airline and therefore be compensated for these extra expenses.

Delta Airlines cancelled flights

A cancelled flight is something that can happen to anyone and it may be due to many inconveniences. In most cases, this can give a lot of trouble to a traveler and it can result in many other expenses which could make air passengers very unhappy with the airline. It is important to know your rights regarding canceled flights, so you can act accordingly in this unfortunate situation.

As mentioned above, cancelled flights may be due to many inconvenient circumstances which can be out of the airline’s control. If the actual reason is an extraordiny circumstance then you are not eligible for compensation. But for any other reason, you are entitled to:

  1. A refund of the ticket. 
  2. A flight rebooked for the next available departure.
  3. A rebooking of the tickets for a later date of your choice

There are also other cases, where you can be denied boarding due to overbooked flights. Overbooking is something that big airlines like Delta does in order to fill up their seats as much as possible. Delta and other airlines do this because many passenger miss their flights or just don’t show up for their flight. That’s why they overbook because they assume not everyone will arrive for the flight. However, if everyone arrives and you are the one they deny boarding to, you have the same rights as for a canceled flight.

If your canceled flights result in you staying overnight in another country then you will have to book a hotel. However, the hotel accommodation with the transportation will be paid by Delta Airlines as long as you have the receipts and these expenses are reasonable.

There are also going to be instances when you will think that you are entitled to compensation or a refund where you actually aren´t. Your full refund or compensation claim will be dropped if:

  • You have been informed of the cancellation 2 weeks before the departure time.
  • You have already been rebooked by Delta Airlines. Here, however, the rebooking must comply with specific time limits.
  • The cancellation is caused by circumstances that are extraordinary, such as storms, terrorist attacks, etc.

European rules and where they apply

The European Union has created a regulation for international flights and domestic flights, the EC 261/2004. What does it mean if your flight is an international flight or domestic flight? Does it matter if you are flying from Europe or outside of Europe? These kinds of factors matter here, as there are certain limitations on the rights of air passengers under the EU regulation.

Even though Delta isn’t an European airline, Delta always follows EU rules when flying from European airports. EC 261 provides a global protection system for passengers travelling from Europe to the United States with Delta. The airline will provide passengers with compensation for delays and cancellations in their flights.
